Terms of service
Cue the Tape is operated by Ferroni Holdings, LLC ("we", "us"). These terms apply to cuethetape.com and the Cue the Tape service. By creating an account or using the service you agree to them.
1. What the service does
Cue the Tape makes short product videos. You give us a website address, and optionally images, clips, music or a written brief. We read the site, describe the product back to you for approval, then design the video's scenes, artwork, motion and sound with the help of AI models. You can then edit the video in your browser and export it as an MP4 file in one or more formats.
2. Accounts
You need an account to make videos. You sign in with Google or with a link we email you. You are responsible for what happens under your account and for keeping your email access secure. One person may hold one account. You must be at least 18 years old, or the age of majority where you live, to use the service.
3. Previews, credits and payment
Purchasing is not yet available. During the early test the service is free, within the limits we set for each account. The rules below apply once credits go on sale.
- Each account can make two free preview videos. Previews carry a watermark.
- Credits are sold in packs, priced on the pricing page. One credit unlocks one video: it removes the watermark and includes editing, scene redos (five included, then one credit for every further five), all formats, an original soundtrack and export.
- Credits are tied to your account, cannot be transferred or exchanged for cash, and do not expire while your account is open. A generation that fails never uses a credit.
- Payments are processed by Paddle.com, our merchant of record. Paddle's own terms apply to the transaction. Prices are shown in US dollars; sales tax or VAT is added at checkout where it applies.
- Refunds follow our refund policy.
- We may change prices. A change applies to purchases made after it is published, never to credits you already hold.
4. Your content
"Your content" means the website, images, clips, music, text and other material you give us, and the videos made from them. You keep all rights to your content. You give us a licence to store, copy, process, send to our service providers and display your content, only as needed to provide the service to you.
You confirm that you have the right to use everything you give us, including any music you upload, and that your content and the videos you make with it do not infringe anyone's rights or break any law. You are responsible for the claims your video makes about your product.
We do not show your videos to other customers or use them in our own marketing unless you tell us we may.
5. Videos you export
You own the videos you export and may use them for any purpose, including commercially. Because the artwork and motion are generated for your brief, we cannot promise they are unique, and we make no claim to any copyright in them. Where music is composed for a video, it is licensed for use in that video.
6. Acceptable use
Do not use the service to make videos that are unlawful, deceptive, defamatory, hateful, pornographic, or that promote violence or self-harm; to impersonate another business; to infringe someone else's trademarks or copyrights; or to interfere with the service, its security or other people's use of it. Do not share a website whose owner has not allowed you to use it. We may remove content or close an account that breaks these rules.
7. AI-generated material
Videos, product descriptions, artwork, motion and music are produced with AI models from third-party providers. They can contain mistakes, including wrong statements about your product. You review and approve the product description, and you are responsible for checking a video before you publish it. We do not guarantee any particular result, style or level of quality.
8. Availability and changes
The service is in early testing and nothing is on sale yet. It may be unavailable, slow, or changed without notice, and features may be added or removed. We will try to warn you before removing something you rely on.
9. Closing an account
You can close your account at any time by emailing us; we will delete your content as described in the privacy policy. We may suspend or close an account that breaks these terms. In either case, unused credits are refunded only as the refund policy allows.
10. Disclaimers
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
12. Indemnity
You will defend and indemnify us against claims arising from your content, the videos you publish, or your breach of these terms.
13. Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Colorado, except that either side may seek an injunction in any court with jurisdiction.
14. Changes to these terms
We may update these terms. The date at the top is the version in force. For a substantive change we will email account holders at least 14 days before it takes effect. Using the service after that date means you accept the change.
